Except for your Submitted Materials (as defined below), PopFiltr or its licensors own all rights, title, and interest in and to the Services, including all content, code, data, and materials thereon, and the compilation of the content, code, data, and materials on the Services, including but not limited to any copyrights, trademark rights, patent rights, database rights, moral rights, sui generis rights, and other intellectual property and proprietary rights therein.
If you provide PopFiltr any feedback or suggestions regarding the Services (“Feedback”), you hereby assign to PopFiltr all rights in the Feedback and agree that PopFiltr shall have the right to use such Feedback and related information in any manner it deems appropriate.
You may access and view the content on the Services on your computer or other devices and, unless otherwise indicated in these Terms of Use or on the Services, make single copies or prints of such content for your personal, internal use only. Use of the Services and the services offered on or through the Services are only for your personal, non-commercial use.
Any commercial or promotional distribution, publishing, or exploitation of the Services is strictly prohibited unless you have received the express prior written permission from authorized personnel of PopFiltr or the otherwise applicable rights holder. PopFiltr may, from time to time, make messaging services, chat services, bulletin boards, message boards, comment sections, blogs, other forums, and other such services available on or through the Services. You agree that you shall not upload, post, transmit, distribute, or otherwise publish through the Services any Submitted Materials which restrict or inhibit any other user from using and enjoying the Services, are fraudulent, unlawful, threatening, abusive, harassing, libelous, defamatory, obscene, vulgar, offensive, pornographic, profane, sexually explicit, or indecent.
PopFiltr reserves the right, but does not have an obligation, to monitor and/or review all Submitted Materials and PopFiltr is not responsible for any such Submitted Materials. However, PopFiltr reserves the right at all times to disclose any Submitted Materials as necessary to satisfy any law, rule, regulation, or government request, or to edit, refuse to post, or to remove any Submitted Materials, in whole or in part, that PopFiltr considers to be objectionable or in violation of these Terms of Use.
It is important to remember that comments submitted to a forum may be recorded and stored in multiple places, both on our Services and elsewhere on the Internet, which are likely to be accessible for a long time and you have no control over who will read them now or in the future. It is therefore important that you are careful and selective about the personal information that you disclose about yourself and others, and in particular, you should not disclose sensitive, embarrassing, proprietary, or confidential information in your comments to our public forums.
We may make certain products available to visitors and registrants of the Services. The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. PopFiltr disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. PopFiltr does not represent or warrant that materials in the Services are accurate, complete, reliable, current, or error-free.
You agree to defend, indemnify, and hold harmless PopFiltr, its parent corporation, officers, directors, employees, and agents, from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Services or your breach of these Terms of Use.
Any dispute arising fromthese Terms of Use and your use of the Services will be settled through binding arbitration, in accordance with the rules of a recognized arbitration body, which will be selected by PopFiltr. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party.
PopFiltr reserves the right, without notice and in its sole discretion, to terminate your license to use the Services, and to block or prevent your future access to and use of the Services.
If any provision of these Terms of Use shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.
